City Council Meeting Minutes
April 24, 2012       6:30pm

Item 1                                                                                                           Call to Order
Mayor Roy Perkins called meeting to order at 6:30 p.m. Mayor Pro Tem David Isbell,
and council members John Blain, Johnie Cumbie, Joye Davis, Kathy Kelly, Code
Enforcement Officer Jesse Wood, and secretary Jan Shedd were present.  

Meeting was attended by Robert Chronister, Winn Sandberg, Denny Oats, Robert
LaRue Jerry Cumbie, & Amado Morales.

Item 2***                                                                                Approval of March Minutes
Joye made motion to accept minutes as written.  John seconded motion.   Motion
passed unanimously.  

Item 3                                                                                        7712 N. State Highway 34
Greg and Kevin Farmer were asked to attend meeting, and sent emails stating that
they would come. At the time Council was ready to discuss Item, they had not
arrived.  Jesse received phone call that they were on they were on their way, but
stuck in traffic. Item was postponed until they arrived.

Item 4                                                                                      Danny Potts/Mobile Home
Mr. Potts did not attend meeting.

Item 5                                                                                                 Burning Ordinance
Jerry Cumbie told Council he wanted a word change in Ordinance 3-12, Section II.,
(B), (5), which currently states that burning must be conducted downwind of, or at
least 300 feet from, any structure containing sensitive receptors.  He requested that
“or” be changed to “and.” He noted that the definition of the word “adjacent” does
not preclude properties that are not directly connected (to properties with sensitive
receptors), but can also refer to properties that are nearby. Jerry was also concerned
about the legality of Section II., 1., (6) (a) regarding when a fire may be initiated, and
when it must be extinguished, and Section II. 2., B. which states that “no burning
shall be permitted after sunset, and all fires must be extinguished by sunset.”    
Council instructed Jan to consult attorney regarding proposed changes.

Item 6                                                                                                          Citizen Input
Meeting was attended by Denny Oats of 1080 Oak Lane.  Mr. Oats informed Council
that people do not follow ordinances because they are unaware of them.  Mayor
reminded him that City has a website that people can use.  Mr. Oats said that people
are unaware of the website.  Kathy suggested that the City send at least one letter, if
not a regular newsletter, to all property owners advising them of various issues and
concerns within the City.  Mr. Oats also said that he was unaware of the City’s sign
ordinance, and he wanted to know when some work would be done on the roads,
specifically, the filling of pot holes.

Winn Sandberg wanted some information on the City Council election process, such
as how long have the Council members been in office.  Jan said she would look it up
and let him know.

Item 7                                                                         
              Code Enforcement Report
Jesse read report (attached) to Council aloud.  In regards to the ditch being mowed,
he said that all landscapers needed to be insured, and that the City should require
proof of insurance before landscapers are allowed to mow property.  He also advised
Council that the TXDoT would be mowing the ditch this year, once in June and once
in October.

Item 8***                                                                                    Foster Home Inspections
Jesse was recently called upon to do a foster home inspection in Oak Ridge.  He
borrowed a form from Child Protective Services used by Kaufman County, and made
a few changes, because he wanted more detail included.  He said it takes about 30
minutes to do an inspection, and recommended that Council set fee at $50 for a
regular home inspection, and $100 for a group home inspection.  David made
motion to charge $50 for regular foster home inspections, and $100 for group home
inspections.  Johnie seconded motion.  Motion passed unanimously.

Item 9***                                                           2012 Consumer Price Index Adjustment
Council received letter from the Public Utility Commission advising them that the
2012 rate will be adjusted for inflation, unless they choose to keep it the same.
Current rates are .83 cents for residential, $1.90 for non-residential, and 2.88 for
point-to-point.  Rates would go up to .85 cents for residential, $1.94 for non-
residential, and 2.93 for point-to-point.   Historically, the City has chosen the
maximum allowable CPI-adjusted rates.  Joye made motion to allow increase. John
seconded motion.  Motion passed unanimously.

Item 10                                                                                       Past Permitting Process
Kathy reminded Council that last month, 2 citizens attended meeting and
complained that their homes did not receive inspections during construction which
took place in 2003 & 2004.  Mayor stated that all homes received all required
inspections during those years.  Winn Sandberg stated that his home received no
inspections, and that he knew of 1 or 2 others that were not.  Mayor Perkins stated
that Mr. Sandberg’s home was inspected, to which Mr. Sandberg replied, “I disagree
100%.”  Kathy stated that everyone should know that the City no longer does its
own inspections, and expressed concerns as to whether or not Jesse was legally
qualified to inspect swimming pools.  Jesse told her that he had an inspector
certificate from the Fire Protection Association.  Mr. Oats asked whether or not
there were penalties for builders not getting their work inspected.  He was told that
the subject of a written policy for late fees would soon be taken under consideration
by the Council.

Item 11                                                                                       Building Insurance Bids
After getting another bid, and it being considerably higher than what TML was
charging for property insurance, Council agreed to drop matter until the fall.

Item 12***                                      Resurfacing of Parking Lot & Building Maintenance
John explained that before a surface could be applied to parking lot, grading would
have to be done and drainage would have to be dealt with.  He said that drainage
could require that underground pipe be laid.  Mr. Oats said that he could bid on it,
but a dollar amount for the work would have to be determined by the Council.  Kathy
made motion to table Item, and John seconded motion. Motion passed unanimously.

Council received a mowing bid from Colton Thomas stating that he would mow the
property and ditch twice a month for $140 each.  Kathy recused herself from the
discussion because Colton Thomas is her nephew.  Council discussed and agreed to
hire R & V Services to mow ditch one time, as soon as possible, and to take bids
from other landscapers for mowing of property.  Jesse strongly recommended that
landscapers be required to provide documentation of insurance coverage for at least
one million dollars.  David made motion to hire R & V Services to mow ditch once
for $110.  Joye seconded motion.  Motion passed unanimously.

Item 13***                                      Swimming Pool Permitting and Fencing Discussion
Jesse told Council that he could do inspections as long as there weren’t too many.  
Joye stated that she believed that the 48 inch fence height requirement in the
building codes was insufficient, and recommended that it be changed to 60 inches
minimum.  Kathy made motion to change height requirement for swimming pools
fences from 48 inches to 60 inches.  Joye seconded motion.  Motion passed
unanimously.
David made motion to repeal Ordinance 18-09.  Joye seconded.  Motion passed
unanimously.  Kathy made motion to charge a $100 permit/inspection fee for in-
ground swimming pools, and $50 for above ground pools. David seconded motion.  
Motion passed unanimously.

Item 14***                                          Interlocal Agreement for Subdivision Regulation
Council read agreement submitted by Commissioner Jerry Rowden.  David made
motion to approve.  John seconded motion.  Motion passed unanimously.

Item 15***                                               
    Interlocal Agreement for Road Maintenance
Council read agreement submitted by Commissioner Jerry Rowden.  Jan advised
that requiring County to present proposal to City before work was begun was not
clearly stated in agreement.  John made motion to accept agreement as written.  
Kathy seconded motion.  Motion passed unanimously.

Item 16                                      City Council Compensation & Holding Dual Positions
Council discussed and agreed to drop Item because no council members are
receiving compensation at this time.  Legal advice from attorney was that there is
no conflict in sitting on City Council and the North Kaufman Water Supply board at
the same time.

Item 18***                                                                                        Approval to Pay Bills
David made motion to approve the payment of all invoices received by the City from
March 28th through April 24th.  Joye seconded motion.  Motion passed
unanimously.

Item 19                                                                         
              Set Date of Next Meeting
Council agreed to set next City Council meeting for May 22, 2012 at 6:30 pm.

Greg & Kevin Farmer did not attend meeting. John made motion to adjourn.  David
seconded motion.  Motion passed unanimously.
